Ongoing work to review the Tertiary Education Act (TEA) 2011

Visit of Prof Johann Beckmann

The Tertiary Education Commission (TEC) was set up in 2012 following the enactment of the Tertiary Education Act (TEA) 2011.

Its main mandate is to recommend policies and plans for the development of tertiary education and to advise the minister on the preparation of further legislation on tertiary education, (Part 2 of the Act states 4 (1) TEC shall recommend policies (2) TEC shall make recommendations.

Working with the Act for the past five and a half years has seen many deficiencies and frustrations in its implementation in view of various anomalies with the law in terms of interpretation, ambiguous terminologies, etc. The regulatory aspect of the Act is very lacking and whilst recommending to the Ministry of Education and Human Resource Development (MoEHRD) does not necessarily mean that it will take heed of the recommendations at that particular moment TEC meanwhile remains in tandem.

There is much change taking place at tertiary education level and the mandate of recommending does not fit the bill anymore.

TEC sought technical assistance from the Commonwealth of Learning (CoL) for a review of the Act. Prof Johann Beckmann was identified. He was in Seychelles from the 20th to the 26th August 2017 conducting an initial consultation to identify whether there is really need for a review and he met with the various tertiary education stakeholders – the Minister of MoEHRD, MoEHRD officials, tertiary education institutions, Department of Public Administration, Department of Finance, Department of Employment, etc.

The report from Prof Beckmann will cover the actual state of things (his findings from the one week visit)  and his recommendations on the way forward for the review.

TEC expects Professor Beckmann’s report from the Commonwealth of Learning towards the end of September 2017.
